Terms of Use of the Darujme.cz donation platform

I. Introductory provisions

The Via Foundation is a non-political, independent, nonprofit legal entity serving exclusively public benefit purposes. The mission of the foundation is to support and strengthen the active participation of the public in the development of a democratic society in the Czech Republic.

In order to fulfill its mission, the Via Foundation:

• supports partnerships between the public, private and nonprofit sectors, the participation of citizens in public affairs, and approaches to solving local problems that are based on the involvement of the entire local community;

• strengthens the capacity of nonprofit sector institutions and certain self-governing units to contribute to improving the life of the communities in which these institutions operate;

• serves the philanthropic needs of corporate and individual donors so that these donors become responsible members of the communities in which they operate;

• helps donors decide on the direct allocation of donations so that their use is in line with the mission of the Via Foundation

As part of fulfilling the mission set out above, the Via Foundation operates the Darujme.cz donation portal, through which it provides Users with a comprehensive overview of the options for supporting the nonprofit sector, i.e. public benefit activities and humanitarian, cultural, environmental and other projects organized by nonprofit organizations and other institutions for nonprofit purposes, and enables Providers to make contributions to these nonprofit entities. The Via Foundation is not an entrepreneur within the meaning of Section 420 of the New Civil Code.

The Darujme.cz donation portal further provides Users with:

• education in online fundraising, marketing, running campaigns and peer-to-peer (P2P) campaigns, education in the form of webinars, training and workshops, individual consulting, basic technical support and consultations

• support for corporate philanthropy – consulting, education and the implementation of corporate campaigns

• support for community projects – consulting, education and the implementation of fundraising campaigns and personal fundraisers

The User agrees that, unless otherwise agreed, the relationship between the User and the Via Foundation is governed by the provisions of these Terms.

The Provider agrees that, unless otherwise agreed, the relationship between the Provider and the Via Foundation, as well as the relationship between the Provider and the Recipient, is governed by the provisions of these Terms.

The Recipient agrees that, unless otherwise agreed, the relationship between the Recipient and the Via Foundation, as well as the relationship between the Recipient and the Provider, is governed by the provisions of these Terms.

II. Methods of making contributions and handling of contributions

Making contributions

In the making of contributions through the donation portal, the Via Foundation acts solely as an intermediary which, on the basis of a contract with the specific Recipient, arranges the receipt of the contribution and its transfer, all to the account of the specific Recipient.

Contributions are made by Providers to individual Recipients through the donation portal operated by the Via Foundation in the manner and under the conditions set out in the fundraising rules laid down directly by the individual Recipients.

Depending on the rules of the specific Recipient, these are in particular the following methods of making contributions:

1. Donation – By making a donation, i.e. by crediting a financial contribution to the relevant account under the conditions set out herein, a donation agreement is concluded, the subject of which is the donation of the contribution to the Recipient designated by the Provider and the acceptance of this contribution by the Recipient, whereby these Terms become part of the donation agreement.

2. Public collection – At the moment the contribution is credited to the account of the Via Foundation donation portal, the contribution is deemed to have been made to the specific public collection held by the Recipient as specified by the Provider. In accordance with the Public Collections Act, as amended with effect from 1 January 2025, this regime applies to cashless collections into a bank account only if the Recipient has voluntarily opted for it.

No written donation agreement for individual donations is provided or generated by the portal. Together with the contribution, the Provider shall provide the Via Foundation with all the required data necessary for transferring the contribution to the intended Recipient or for sending it to a specific public collection, as well as any data the Provider wishes to have stated on the donation certificate. This is in particular the identification of the Provider and the identification of the Recipient or its specific public collection, usually in the form of a variable symbol (payment reference), which the Provider will find on the website www.darujme.cz. Relationships arising from the processing of personal data by the Via Foundation within the user account or the accounts of the Recipient as the data controller will be governed by a separate agreement containing the rules for the processing of personal data. The Darujme.cz service is strictly intended for legal entities; a natural person therefore cannot be registered in the program as a recipient of financial assistance. Darujme.cz also reserves the right not to register an organization for ethical reasons, as well as in the case of suspected violations of human rights and freedoms or of the laws of the Czech Republic. The Recipient undertakes to regularly (annually) publish an annual report, including its financial section, which is normally available on the Recipient's website.

By making a contribution, the Provider also confirms that they have read these Terms, that they accept them and that they are making the contribution in accordance with them. The Provider thereby also confirms that all the data they have provided about themselves is true and that they are the person who made the contribution and who is the rightful recipient of the donation certificate for tax purposes.

By making a contribution, the Provider also declares that the funds provided come from legal sources.

The Provider is aware that making a contribution does not give rise to any rights to use the trademarks, trade names, company logos or other intellectual or industrial property of the Via Foundation, the Recipients or any other persons.

Contributions may be made by Providers through one of the payment channels available within the Darujme.cz donation portal, in particular:

• payment by bank transfer to the account of the operator – the Via Foundation,

• online payment by payment card,

• payment by instant bank transfer via the PayU tool,

• payment via Google Pay,

• payment via Apple Pay (only in the Safari browser)

Handling of contributions

For the purposes of operating the donation portal, the Via Foundation has established a special fund – hereinafter referred to as the “Fund”; this Fund is not a separate legal entity and therefore has no legal personality, it is established by the Via Foundation and serves to administer the contributions made by Providers within the activities of the donation portal and to distribute them to Recipients as specified by the Providers. The Statute of the Fund referred to in this paragraph is available on the website of the donation portal, www.darujme.cz.

The Via Foundation receives contributions made through the donation portal into a special account separate from its other funds and keeps them in this account until the moment it disposes of them in accordance with these Terms.

The Via Foundation is bound by the Provider's instruction regarding the addressee of the contribution. The Via Foundation therefore undertakes to transfer the received contribution, within the period set out in the intermediary agreement concluded with the Recipient, to the account of the Recipient designated by the Provider, and at the same time to pass on to the Recipient the information about the purpose of the contribution or its designation for the specific collection to which it is addressed.

If the Provider fails to provide the data necessary to deliver their contribution to the specific Recipient, the Via Foundation will take steps to obtain the missing information. If this is unsuccessful, the Via Foundation will return the contribution to the Provider. A contribution that cannot be returned to the Provider, or where a return is not possible, remains in the Fund and will be used to cover the operating costs of the portal. Contributions that are sent regularly without the data necessary to match the donation and that have already been returned to the Provider three times without any response from the Provider also remain in the Fund.

If an organization finds that it wants or needs to return a donation that has already been transferred, it must contact the donor itself, request their account number and return the donation to them in full. The intermediary fees deducted from the organization are non-refundable, and the donation cannot be returned through Darujme.cz.

In the case of a recurring donation set up by card, the Provider may cancel the existing recurring donation in their personal profile on darujme.cz (if registered) or send a request to cancel the donation by e-mail to podpora@darujme.cz. A recurring donation set up by bank transfer is cancelled by the donor themselves in their online banking.

The Recipients who run the individual projects are responsible for meeting all legal and official requirements for raising funds for public benefit purposes for those projects. Likewise, these Recipients are responsible for using the contribution in accordance with the public benefit purpose specified by the Provider, and in accordance with their own rules and the purpose of the given program, project, collection, etc.

If an organization has its own donation form, it must always be clearly indicated whether the donation is recurring or one-time. The donor must be clearly informed that they are committing to recurring giving. We recommend, for example, the label “I donate regularly” or another clear distinction.

The Via Foundation is not liable for damages arising as a result of a breach of legal regulations, the founding or constituent documents of nonprofit organizations, internal regulations, instructions or other internal rules and procedures, these Terms or contracts by any Provider or Recipient.

Donation certificate

The Provider may deduct the value of a donation made or a contribution to a public collection from their tax base, provided that the conditions of Act No. 586/1992 Coll., on Income Taxes, as amended – hereinafter referred to as the “Income Tax Act” – are met.

The Via Foundation will send the Provider an e-mail confirmation of the contribution (which does not constitute a certificate for tax purposes) with a notice that a certificate for tax purposes may be issued directly by the Recipient. The Provider may subsequently request a donation certificate from the specific Recipient.

Conditions for deducting a donation from the tax base under the Income Tax Act:

Conditions for natural persons, including employees (under Section 15(1) of the Income Tax Act): Natural persons (including employees) may deduct the value of donations from their tax base if the total value of donations in the tax period (calendar year) exceeds 2% of the tax base or amounts to at least CZK 1,000. In total, no more than 30% of the tax base may be deducted (the increased limit applies until 2026 under Act No. 24/2025 Coll.; the standard limit is 15%). Self-employed persons claim the donation deduction directly in their tax return. Employees who file their own tax return claim the deduction in the same way as self-employed persons – i.e. in their tax return. Employees whose annual tax settlement is processed by their employer submit the donation certificate to their payroll department once a year, no later than 15 February, for the entire previous year. The reduction of the tax base is then reflected in the annual tax settlement, usually in a higher March salary payment.

Conditions for legal entities (under Section 20(8) of the Income Tax Act): Legal entities may deduct the value of donations from their tax base if the value of the donation is at least CZK 2,000. In total, no more than 30% of the already reduced tax base may be deducted (the increased limit applies to tax periods ending on or before 28 February 2027 under Act No. 24/2025 Coll.; the standard limit is 10%). This deduction cannot be claimed by taxpayers that were not founded or established for the purpose of doing business. For tax purposes, the donation must therefore amount to at least CZK 2,000.

IV. Covering the costs of the portal

The Via Foundation is entitled to deduct from the contribution an amount corresponding to the costs associated with the operation, maintenance and development of the portal. The specific fee amounts can be found on the Pricing page.

Any accruals to the contribution arising between the crediting of the contribution to the account of the Via Foundation and its transfer to the account of the Recipient are not transferred and serve to cover the costs associated with the performance of the Via Foundation's obligations.

V. Final provisions

The User, the Provider and the Recipient agree that the Via Foundation is entitled to perform its obligations under these Terms through the Administrator.

These Terms come into force and take effect on 1 April 2021. They were last updated on 20 August 2026. The Via Foundation is entitled to amend and supplement these Terms; any amendment or supplement takes effect upon its publication on the website www.darujme.cz, unless otherwise specified by the Via Foundation.

Information on personal data processing

How it works

Darujme.cz is a donation portal operated by the Via Foundation (“we” or “our foundation”). Its purpose is to provide organizations (“organizations”) with a space to collect donations for various charitable, philanthropic or public benefit projects and to offer donors a simple and secure way to donate.

Through Darujme.cz, you can contribute to a specific organization's projects. You choose a project, enter the amount of your donation and fill in basic information about yourself. By clicking the donate button (usually labeled “Donate”, but it may also have other labels such as “Contribute”, “Support”, etc.), you pledge to make a donation to the selected nonprofit organization. Once the organization you have chosen receives your donation in its bank account, a donation agreement is concluded between you and the selected organization. Our Foundation acts as an intermediary in the making of the donation; we pass on the information about you and your donation to the organization, which is the contracting party, in particular so that it can thank you and inform you about how the donated funds are used, record your donation in its accounts and issue you a donation certificate that can be used to claim a deduction in your tax return. Donation payments are received and distributed to organizations through the Darujme.cz Fund, which was established by our Foundation for this purpose. The Darujme.cz Fund has no legal personality of its own and is managed by our foundation.

Darujme.cz also allows the registration of user accounts. In their account, users can view an overview of their donations and edit certain details. Users can also support charitable and public-benefit projects on Darujme.cz by sharing them and thereby helping to raise donations for them through so-called personal fundraisers. We refer to such users as ambassadors.

A user account is also required for access if you are the administrator of an organization registered on Darujme.cz.

DONOR

Data controller

The operator and controller of the personal data collected through Darujme.cz is Nadace Via (Via Foundation), Company ID (IČO): 67360114, registered office: Dejvická 306/9, 160 00 Praha 6 – Dejvice, entered in the Register of Foundations kept by the Municipal Court in Prague under file No. N 395.

Why we process your personal data

We use personal data primarily to facilitate the donation process between you and the selected organization and to pass the donation you have sent on to the organization. We receive information about the payment of the donation from payment institutions. This processing is carried out for the purpose of performing the donation agreement which, when making a donation, you enter into directly with the selected organization you have decided to support. Our foundation acts as an intermediary in the donation process.

If you made your donation in response to an ambassador's fundraiser, we will disclose your name and the amount of your donation to the ambassador. We carry out this processing on the basis of the legitimate interest of third parties – the ambassadors.

We also process personal data for the purpose of matching donation payments. If a payment is incorrectly identified (for example, the variable symbol (payment reference) is missing), we may use recent historical information for matching and contact you to verify the donation payment. In this way we avoid having to return incorrectly identified payments and ensure maximum convenience for you and the organizations. We carry out this processing on the basis of the legitimate interest of the controller.

On the basis of the legitimate interest of the controller, we also process your personal data for the purposes of compiling statistics and archiving in the event of disputes or complaints.

Legal regulations further require us to archive certain personal and other data, in particular for accounting purposes, such as first name, surname, address, the amount of the donation and the number of the bank account from which the donation was sent.

How does sharing personal data with organizations work?

We pass your personal data on to the organization to which you are making the donation. The organization is a party to the donation agreement that you enter into through Darujme.cz. We provide organizations with your contact and identification details and information about the donation made and its payment. Organizations are also controllers of your personal data. This means that they have their own terms for the processing of personal data. Our foundation is not liable for how organizations handle personal data, but it requires organizations, for every project they create in the Darujme.cz system, to inform donors about how they process personal data (note: as a rule, this only covers the scope necessary for concluding the donation agreement, thanking you and informing you about how your donation has been used).

The donation forms of some organizations may require you to provide additional personal data. In such cases, the organizations are the sole controllers of the personal data. Our foundation does not use this information in any way; we only store it in order to fulfill the functions of the system. If you tick a checkbox consenting to the processing of personal data during the donation process, this consent is given directly to the organization. Organizations are responsible for setting up these consents. We recommend that you read the information on how the organization processes donors' personal data before making a donation.

Who else may have access to personal data?

We disclose your name and the amount of your donation to the ambassador if you have supported their project. Otherwise, we only disclose your personal data to trusted processors.

Where we store personal data

We use secure electronic storage located in the member states of the European Union. This is important because EU countries provide a uniformly high level of protection for personal data. This strengthens the security of your data.

Personal data retention period

We archive information about each donation for 3 calendar years from the date it was made, in case of a complaint or dispute, after which we anonymize it. If you have made several donations through Darujme.cz, we only ever archive the donations made in the last 3 years, unless legal regulations require a longer archiving period. For a limited period, we may use the archived data for payment matching.

For recurring donations, we retain the data for three years from the last payment received.

I am also a user – how does the processing of my donation differ?

Information about the donations you have made will be displayed automatically in your user account. The display of donations is then not limited by the 3-year archiving period. Your user account will contain your complete donation history, provided that the information about a donation was not deleted before you created your user account.

What rights you have

Under legal regulations, you have the right to ask us to provide you with information or to carry out certain operations with your personal data. Our foundation is responsible for handling requests concerning personal data processed in the course of facilitating a donation, as described in this document. If your request concerns the processing of personal data by an organization, please contact that organization directly.

• Right of access: You have the right to obtain a copy of the personal information we hold about you and certain information about how we use it.

• Right to rectification: If you believe that the information we hold about you is inaccurate, you can ask us to update or change it.

• Right to object: You have the right to object to processing that we carry out on the basis of a legitimate interest. For example, you can ask us not to disclose your name to the ambassador. If we do not have a compelling legitimate ground for the processing, we will no longer process the personal data for that purpose.

• Right to data portability: In certain circumstances, you have the right to ask us to provide you with your personal data in a machine-readable format. For example, you can ask us to provide you with a list of the donations you have made through Darujme.cz. You can also ask us to transfer the data to a third party.

• Right to erasure: In certain circumstances, you have the right to ask us to erase your data, for example if the personal data is no longer necessary for the original purpose. However, this must be balanced against other factors and our legal obligations

• Right to restriction of processing: In certain circumstances, you have the right to ask us to stop using your personal data, for example if you believe that it is inaccurate or if you believe that there is no need for us to continue using your personal data.

A request may only be submitted by you or, where applicable, your authorized representative. If we are not certain of the identity of the applicant, we may ask you for further information in order to verify your identity.

In some cases, our obligation to comply with a request depends on the purpose for which we process your data. Some rights can only be exercised for certain purposes of processing, or exceptions apply.

Why we process your personal data

Your user account will store information about all donations you have made through Darujme.cz for as long as your user account exists. When you create a user account, we will also load into it the donations you have made through Darujme.cz in the last 3 years, provided that they were made with the same e-mail address you used to register the account.

If you are logged in to the Darujme.cz system and wish to make a donation, we will automatically pre-fill your identification and contact details in the donation form to make the process as easy as possible for you.

Through your account, you can share organizations' projects and, for example, start a personal fundraiser for them. This makes you an ambassador of the project, which you can promote within your community, and you can set goals for how much you want to help raise for the project. In your account, you will have access to information about the donations with which donors have supported your personal fundraiser.

We process personal data in this way with your consent. You can withdraw your consent at any time by closing your user account.

Our system may store certain technical information about how you use our service, such as logs. We process this information for the purpose of securing our systems. This processing is carried out on the basis of the legitimate interest of our foundation as the controller.

Registration and login via social networks (FB, Google, Apple, LinkedIn)

To make registration and logging in easier, we allow you to use authentication through third-party services (Single Sign-On):

• Facebook Login (Meta Platforms Ireland Ltd.)

• Google Sign-In (Google Ireland Limited)

• Sign in with Apple (Apple Distribution International Ltd.)

• LinkedIn Sign-In (LinkedIn Ireland Unlimited Company)

If you use login through these services, the platform concerned will, on the basis of your approval, pass on to us only basic data:

• E-mail address (used to identify the account, to log in and to deliver operational e-mails and donation certificates)

• First name and surname (for identification and for pre-filling details for donations or campaigns)

• The unique user ID of the platform concerned (for securely matching your account when you log in again)

• Profile picture / avatar (if the platform passes it on, it is used only for display in your profile)

We do not obtain or process your passwords, lists of friends/contacts or the content of your posts from these services.

Who we share personal data with

We only disclose your personal data to trusted processors. You yourself always control where and how you publish your ambassador projects – personal fundraisers.

Where we store personal data

We use secure electronic storage located in the member states of the European Union. This is important because EU countries provide a uniformly high level of protection for personal data. This strengthens the security of your data.

Personal data retention period

We retain the information in your user account and about you for as long as the account exists. If you close your account, we will delete its contents within 1 month. Deletion from backups is subject to backup retention periods. We retain technical information about the use of the system for a maximum of 6 months. We will retain information about the donations you have made in accordance with the archiving periods for donations made. You can find more information in the “DONOR” section.

What rights you have

Under legal regulations, you have the right to ask us to provide you with information or to carry out certain operations with your personal data.

• Right to withdraw consent: We process the data in your user account on the basis of consent. You can withdraw your consent at any time. We regard the closing of a user account as a withdrawal of consent. If you withdraw your consent for only some of your personal data, this may impair the functioning of your account.

• Right to erasure and Data Deletion Instructions: In certain circumstances, you have the right to ask us to erase your data (e.g. if it is no longer needed or if you withdraw your consent). You can have the data obtained through logging in via social networks (Facebook, Google, Apple, LinkedIn) deleted in the following ways:

  1. By closing and deleting your account directly in your profile settings on Darujme.cz.

  2. By sending a request to the e-mail address podpora@darujme.cz with the subject “Request for deletion of personal data / FB data deletion”. We will completely remove both your data obtained from social networks and your account within 30 days (with the exception of data we are required to archive by law, e.g. accounting records).

  3. By revoking the access of the Darujme.cz application directly in the privacy and application settings of the social network concerned (e.g. on Facebook in Settings and privacy -> Settings -> Apps and websites).

• Right of access: You have the right to obtain a copy of the personal data we hold about you and certain information about how we use it.

• Right to rectification: If you believe that the information we hold about you is inaccurate, you can ask us to update or change it.

• Right to data portability: You have the right to ask us to provide you with your personal data in a machine-readable format. For example, you can ask us to provide you with a list of the donations you have made through Darujme.cz. You can also ask us to transfer the data to a third party.

• Right to restriction of processing: In certain circumstances, you have the right to ask us to stop using your personal data, for example if you believe that it is inaccurate or if you believe that there is no need for us to continue using your personal data.

ORGANIZATION ADMINISTRATOR

Why we process your personal data

We process your personal data for the purpose of performing the agreement we have concluded with your organization, generally for mutual communication and to provide you with secure access to the administration of your organization in the Darujme.cz system. The Darujme.cz database records activity in user accounts, for example by means of logs, in order to ensure the security of the systems.

We carry out this processing on the basis of the legitimate interest of the data controller.

You can also sign in to your administrator account using social networks (Facebook, Google, Apple, LinkedIn) under the conditions described in the “USER” section.

Who we share personal data with

We make your personal data available only to trusted data processors.

Where we store personal data

Retention period of personal data

We process your personal data for as long as you are an administrator of an organization's user account. We may retain our communication with you for a longer period for the purpose of performing the contract with the organization, or logs for the purpose of ensuring the security of our systems.

What if I am also an ambassador or want to become one?

In your user account, you can activate all the features available to any other user of the system – for example, start a personal fundraiser.

If you cease to be an administrator of an organization, your user account will be retained, but all administrator access rights will be removed from the account.

What rights you have

Under applicable law, you have the right to ask us to provide you with information or to carry out certain operations with your personal data.

• Right of access: You have the right to obtain a copy of the personal data we hold about you and certain information about how we use it. This right may be limited in order to protect the information of third parties.

• Right to rectification: If you believe that the information we hold about you is inaccurate, you can ask us to update or amend it.

• Right to object: You have the right to object to processing that we carry out on the basis of legitimate interest. If we do not have a compelling legitimate ground for the processing, we will no longer process the personal data for that purpose.

• Right to erasure: In certain circumstances, you have the right to ask us to erase your data, for example if the personal data is no longer necessary for the original purpose. However, this must be balanced against other factors.

• Right to restriction of processing: In certain circumstances, you have the right to ask us to stop using your personal data, for example if you believe it is inaccurate or if you believe that there is no need for us to continue using your personal information.

• Right to data portability: This right does not apply to you, as it applies only to processing carried out for the performance of a contract concluded with you or processing based on consent. We do not carry out such processing.
